The words of which the initial letter is capitalized have meanings defined under the following conditions. All capitalised terms not defined herein shall have the meaning ascribed to them in the Terms.   • Company (referred to as either "the Company", "We", "Us" or "Our" in this Agreement) refers to Whalesbook Private Limited, having its registered office at C-90 G/F Dayanand Colony, Lajpat Nagar 4, South Delhi, New Delhi, Delhi India 110024.
  • Country refers to: Delhi, India
  • Device means any device that can access the Service such as a computer, a cell-phone or a digital tablet.
  • E-Newspaper means the digital financial news publication, articles, and related content published and potentially sold by the Company through the Service.
  • Personal Data is any information that relates to an identified or identifiable individual.
  • Service refers to the Whalesbook platform, including the Application, website, E-Newspaper, Alerts, Community Features, and any related services provided by the Company.
  • Service Provider means any natural or legal person who processes the data on behalf of the Company. It refers to third-party companies or individuals employed by the Company to facilitate the Service, to provide the Service on behalf of the Company, to perform services related to the Service or to assist the Company in analysing how the Service is used (e.g., WhatsApp for delivering Alerts).
  • Third-party Social Media Service refers to any website or any social network website through which a User can log in or create an account to use the Service.
  • Usage Data refers to data collected automatically, either generated by the use of the Service or from the Service infrastructure itself (for example, the duration of a page visit).
  • You means the individual accessing or using the Service, or the company, or other legal entity on behalf of which such individual is accessing or using the Service, as applicable.

Information We Collect

The personal information requested and the reasons for its collection will be transparently communicated when you provide it on our platform (e.g., when registering, subscribing, or opting into Alerts).

If you contact us directly, we may receive additional information such as your name, email address, phone number, the contents of the message, attachments, and any other details you choose to provide.

When registering for an Account, we will ask for your contact information, including items such as name, email address, and telephone number (required for WhatsApp Alerts). We may also collect information related to your subscription or service preferences.

Personal Data

While using Our Service, We may ask You to provide Us with certain personally identifiable information that can be used to contact or identify You, deliver services, and facilitate interactions. Personally identifiable information may include, but is not limited to:

  • Phone number (particularly for WhatsApp Alerts)
  • Address, State, Province, ZIP/Postal code, City (for billing or optional profile information)
  • Information you post or share in Community Features

Usage Data

Usage Data is collected automatically when using the Service.

Usage Data may include information such as Your Device's Internet Protocol address (e.g. IP address), browser type, browser version, the pages of our Service that You visit, the time and date of Your visit, the time spent on those pages, unique device identifiers and other diagnostic data.

When You access the Service by or through a mobile device, We may collect certain information automatically, including, but not limited to, the type of mobile device You use, Your mobile device unique ID, the IP address of Your mobile device, Your mobile operating system, the type of mobile Internet browser You use, unique device identifiers and other diagnostic data.

The Company allows You to create an account and log in to use the Service through the following Third-party Social Media Services:

If You decide to register through or otherwise grant us access to a Third-Party Social Media Service, We may collect Personal data that is already associated with Your Third-Party Social Media Service's account, such as Your name, Your email address, Your profile picture, Your activities or Your contact list associated with that account, subject to the permissions you grant.

You may also have the option of sharing additional information with the Company through Your Third-Party Social Media Service's account. If You choose to provide such information and Personal Data, during registration or otherwise, You are giving the Company permission to use, share, and store it in a manner consistent with this Privacy Policy.

Use of Your Personal Data

The Company may use Personal Data for the following purposes:

  • To provide and maintain our Service, including publishing the E-Newspaper, delivering Alerts via WhatsApp, facilitating Community Features, and monitoring the usage of our Service.
  • To manage Your Account: to manage Your registration as a user of the Service. The Personal Data You provide can give You access to different functionalities of the Service that are available to You as a registered user.
  • For the performance of a contract: the development, compliance and undertaking of the purchase contract for subscriptions to our E-Newspaper, access to premium content, or other services You have purchased or contracted with Us through the Service.
  • To contact You: To contact You by email, telephone calls, SMS, WhatsApp (specifically for Alerts You opted into), or other equivalent forms of electronic communication (such as push notifications) regarding updates, delivery of purchased content (like the E-Newspaper), informative communications related to the functionalities, products or contracted services (including Alerts and security updates), when necessary or reasonable for their implementation.
  • To provide You with news, special offers and general information about our E-Newspaper, Alert services, community updates, and other goods, services and events which we offer that are similar to those that you have already purchased or enquired about, unless You have opted not to receive such marketing information.
  • To manage Your requests: To attend and manage Your requests to Us.
  • To facilitate interaction within Community Features: To enable You to connect, share information, and interact with other users as permitted by the platform's functionalities, and to display Your profile information (like name, profile picture) in these areas.
  • For business transfers: We may use Your information to evaluate or conduct a merger, divestiture, restructuring, reorganization, dissolution, or other sale or transfer of some or all of Our assets, whether as a going concern or as part of bankruptcy, liquidation, or similar proceeding, in which Personal Data held by Us about our Service users is among the assets transferred.
  • For other purposes: We may use Your information for other purposes, such as data analysis, identifying usage trends, determining the effectiveness of our promotional campaigns and to evaluate and improve our Service, products, services, marketing and your experience.

Sharing Your Personal Information

  • With Service Providers: We may share Your personal information with Service Providers to monitor and analyze the use of our Service, to process payments, to deliver Alerts (e.g., sharing Your phone number with WhatsApp or a similar provider), to host data, or to otherwise assist in operating our business and providing the Service to You.   • For business transfers: We may share or transfer Your personal information in connection with, or during negotiations of, any merger, sale of Company assets, financing, or acquisition of all or a portion of Our business to another company.
  • With Affiliates: We may share Your information with Our affiliates, in which case we will require those affiliates to honor this Privacy Policy. Affiliates include Our parent company and any other subsidiaries, joint venture partners or other companies that We control or that are under common control with Us.
  • With business partners: We may share Your information with Our business partners to offer You certain products, services or promotions relevant to our user base, subject to your consent where required.
  • With other users (within Community Features): When You share personal information (e.g., post comments, update your profile) or otherwise interact in the public Community Features with other users, such information (including your name, profile picture, and activity descriptions) may be viewed by all users within those features and may be publicly distributed outside in some contexts (e.g., if community content is indexed). If You interact with other users or register through a Third-Party Social Media Service, Your contacts on that service might see Your activity if permissions allow. Other users will be able to view descriptions of Your activity, communicate with You (if enabled), and view Your profile within the Service.

Retention of Your Personal Data

The Company will retain Your Personal Data only for as long as is necessary for the purposes set out in this Privacy Policy (e.g., to maintain your account, provide subscribed services, facilitate community interaction) and to comply with our legal obligations (for example, if we are required to retain your data to comply with applicable tax or financial laws), resolve disputes, and enforce our legal agreements and policies.

The Company will also retain Usage Data for internal analysis purposes. Usage Data is generally retained for a shorter period of time, except when this data is used to strengthen the security or to improve the functionality of Our Service, or We are legally obligated to retain this data for longer time periods.

Delete Your Personal Data

User(s) are entitled to request Us to delete their accounts and their personal information by sending an email with their written request to info@whalesbook.com. Deleting your account may result in the loss of access to subscribed content, historical Alert data, and community contributions associated with that account.

We will do our best to respond promptly and in any event within the timeframe required by applicable law (e.g., typically one month) of the following:

  • Our receipt of Your written request; or
  • Our receipt of any further information We may ask you to provide, to enable Us to verify your identity and comply with Your request, whichever is later.

As an alternative to account deletion, by writing to info@whalesbook.com, You also have the option to request either:

  • the suspension of Your account, after which You may not be able to access certain premium Services or Community Features but might retain access to other parts of the Platform; or
  • temporary deactivation of Your account, where you will no longer be able to log into the Platform but which allows You to request reactivation of your account with your data potentially intact (subject to our retention policies).

If You proceed with permanent deletion (deactivation) of your account, you will lose access to the Platform and the Services, including any User data and personal information associated with Your account. User(s) may request for account restoration within a limited period (e.g., one month, specify if applicable) from the date of notification of account deletion by writing to Us on info@whalesbook.com, although restoration cannot be guaranteed.

When You request deletion of Your data, We follow a deletion process designed to safely and completely remove Your data from Our active servers or retain it only in anonymised form. We try to ensure that Our services protect information from accidental or malicious deletion. Because of this, there may be delays between when You request deletion and when copies are deleted from our active and backup systems.

Please note, however, that We may need to retain certain information when we have a legal obligation (e.g., financial records) or a legitimate basis (e.g., resolving disputes, preventing fraud) to do so, even after a deletion request.

Disclosure of Your Personal Data

We may share information provided by You and data concerning Your usage of the Service with Our affiliates and group entities to enable them to reach out to you in relation to products and/or services offered by them that may be relevant to You, subject to your consent where required. Provided that any affiliate, group entity and third-party service provider with whom the information is shared will be required, on best efforts basis, to comply with standards comparable to ours in relation to maintaining the security and confidentiality of the information.

By using the Platform, You hereby expressly agree and grant consent to the collection, use, storage, and potential sharing of your information by Us as described in this Policy. We reserve the right to share, disclose and transfer information collected hereunder with Our affiliates and group entities. In the event We sell or transfer all or a portion of Our business assets, user information may be one of the business assets that is shared, disclosed or transferred as part of the transaction. You hereby expressly grant consent and permission to Us for disclosure and transfer of personal information for the same.

We may share aggregated or anonymized information and data concerning usage of the Services with Our commercial partners for the purpose of facilitating user engagement, marketing and promotional purposes, market analysis, and other related purposes, ensuring individual users cannot be identified.

Further, We reserve the right to disclose/share personal information with affiliates, group entities and third parties in limited circumstances, including for the purposes of complying with applicable law, responding to duly authorized legal process (like court orders or subpoenas), governmental requests, preventing fraud or imminent harm, and ensuring the security of Our network and services.

Business Transactions

If the Company is involved in a merger, acquisition or asset sale, Your Personal Data may be transferred. We will endeavor to provide notice before Your Personal Data is transferred and becomes subject to a different Privacy Policy, where feasible and legally required.

Children's Privacy

Our Service does not address anyone under the age of 13 (or a higher age if required by local law, e.g., 18 in India for contractual capacity, although platform access might be allowed with parental consent depending on specific service nature and applicable laws). We do not knowingly collect personally identifiable information from anyone under the age of 13 without verifiable parental consent. If You are a parent or guardian and You are aware that Your child has provided Us with Personal Data without Your consent, please contact Us. If We become aware that We have collected Personal Data from anyone under the age of 13 without verification of parental consent, We take steps to remove that information from Our servers.

Use of Cookies

To improve the effectiveness and usability of the Platform for our Users, We use “cookies”, or such similar electronic tools (like web beacons or pixels) to collect information to assign each visitor a unique random number as a User Identification (User ID) to understand the User's individual interests using the identified device. Unless the User voluntarily identifies himself/herself (e.g., through registration), We have no way of knowing who the User is, even if we assign a cookie to the User’s device. The only personal information a cookie can contain is information supplied by the User. A cookie cannot read data off the User’s device hard drive. Our advertisers may also assign their own cookies to the User's device (if the User clicks on their ad banners), a process that We do not control. Our web servers automatically collect limited information about User’s device connection to the Internet, including User’s IP address, when the User(s) uses the Platform. The User's IP address does not identify the User personally in most cases. We use this information to deliver our web pages and content to User(s) upon request, to tailor our Platform to the interests of Our User(s), to measure traffic within the Platform, for security purposes, and potentially let advertisers know the geographic locations from where Our visitors come (in aggregated form).

We have no control over and assume no responsibility for the content, privacy policies or practices of any third party sites or services. Such websites are governed by their respective privacy policies, which are beyond Our control. Once the User(s) leaves Our servers (the User can tell where he/she is by checking the URL in the location bar on the User's browser), use of any information provided by the User is governed by the privacy policy of the operator of the site which the User is visiting. That policy may differ from Our Privacy Policy. If the User can't find the privacy policy of any of these sites via a link from the site's homepage, the User may contact the site directly for more information. We are not responsible for the privacy practices or the content of such third-party websites.
